Spring flooding in South Dakota has damaged many homes and other private property, but the concentration and severity of the damage may fall short of standards for individual assistance from the federal government. KSFY reports that for that to happen, a large number of homes – generally in a concentrated area – must be destroyed or damaged so badly they are uninhabitable. They must be primary residences with losses that aren't covered by insurance.

Augustana College Senior Art Student Show
Graduating art students at Augustana College have their senior show May 2nd through the 21st, at The Eide/Dalrymple Gallery on Commons Circle, 30th St. and Grange Ave. The 11-seniors will give artist talks at noon on Friday, May 6, and Brandoninfo.com reports the opening reception's from 5 to 7 the same night. The exhibition include's a range of mediums, including ceramics, sculptures, printmaking, paintings, drawings, digital photography and graphic design.
South Dakota hasn't spent much on the Healthcare challenge
South Dakota is one of 27 states challenging the Affordable Care Act, saying Congress can't force people to buy health insurance. Attorney General Marty Jackley said this week, so far that has cost South Dakota about $300. $25,000 has been budgeted. The next hearing is June 8.
3 Fail Alcohol Compliance Check
3 Souix Falls Business have failed an undercover sting operation to check for alcohol sales compliance. Of the 25checked, 3 sold to a person under the age of 21.The clerks were issued citations and are required to appear in court. The businesses face fines. They include Gary Cone’s Amoco Hilltop on South Cleveland, Lewis Drug on East 26th Street and The Gas Stop on South Cliff Avenue.
Death at a Steel Business Being Investigated
Adeadly accident in Sioux Falls last night is being investigated. A man died after he was run over by a truck at a steel business. The accident happened at Zabel Steel at 5501 W. 9th Street at about 1:30. Police say a 74-year-old Sioux Falls man was backing into the lont when he hit a 59-year-old man who was on foot. The victim who has not been identified, was taken to Sanford Hospital where he later died.
Loyalty Day Celebration in Brandon
May 1st each year is designated as Loyalty Day by a Congressional Act in 1958. This is the 45th Annual Loyalty Day Celebration in Brandon. This year’s theme is “Remember”. Brandon has the distinction of having the largest Loyalty Day Celebration in the State of South Dakota, as well as the third largest in the United States. Teachers Honored
Two South Dakota have been chosen for the Presidential Award for Excellence in Mathematics and Science Teaching. KELO reports Constance Ahrens of Rapid City received the award for math. Deborah Thorp of Lead got the award for science.
The award alternates annually between kindergarten to 6th grade teachers and 7th through 12th grade teachers. This year's award was given at the K-6 level.

State Prison Inmate Back in Custody
A state prison inmate that walked away from a minimum security unit in Sioux Falls earlier this week is back behind bars. KDLT reports Kent Davidson was captured in Sioux Falls this morning. He walked away from Unit C, the minimum security facility on the grounds of the South Dakota State Penitentiary, on April 25th.
Sioux Falls Man Charged in Child Sex Case
34-year old Ivery Baynham's been indicted by a Minnehaha COunty grand jury for rape, sexual contact with a child under 16, and sexual exploitation. A published report says the charges against Baynham are from a of alleged sexual attacks that occurred between 2005 and 2007 in South Dakota, involving a child who was between 5 and 7 at the time. The child's reported to be the daughter of Baynham's then girlfriend.
Service First Federal Credit Union robbed again
Sioux Falls police are looking for a suspect in yesterday's robbery of Service First Federal Credit Union on Kiwanis Avenue. The armed robber made off with an undisclosed amount of cash. Police are investigating to see whether this might be connected to a January robbery at the same bank. Police say there were similarities.
Brandon student in national poetry contest
A senior at Brandon Valley High School is in Washington DC today to compete in a national poetry contest. Melissa Johnston won the state contest and represents South Dakota at the national Poetry Out Loud competition. The program is sponsored nationally by the National Endowment for the Arts and the Poetry Foundation. It's the semifinals today and the finals tomorrow.

Attorney General Marty Jackley announces that arraignment has been scheduled for Rodney S. Berget on Friday, April 29, 2011, at the Minnehaha County Courthouse, at 9:30 a.m. Berget and and Eric Robert are implicated in the murder of Correctional Officer Ronald "RJ" Johnson and the assault of Correctional Officer Matthew Freeburg in an attempted escape.

The City of Huron may need a mayor soon. A recall effort has been launched by residents after the city allegedly violated Former police chief Doug Schmitt's First Amendment rights. Mayor David McGirr and city commissioners put him on leave last month after he told a legislative committee he believed some companies in Huron hire illegal immigrants. Sioux Falls Bank Robbery
Sioux Falls Police say a gunman robbed the Service First Credit Union on Kiwanis just before noon today. There were no customers in the bank at the time, and noone was injured. KDLT reports the suspect, an African-American man wearing a hooded sweatshirt, baseball cap, and a bandanna over his face, got away with an undetermined amount of cash. The same bank was robbed last December.
State Supreme Court Takes on Sioux Falls and Due Process
The South Dakota Supreme Court heard arguments this week in a case that could force Sioux Falls to change how it deals with complaints about traffic tickets, contract disputes, and employee grievances. The Argus Leader reports that in the Daily vs. Sioux Falls case, the court's being asked to decide whether the city's administrative appeals process violates due process by forcing people to prove their innocence.
SD soldiers headed home
About 200 South Dakota National Guard soldiers who have served a year in Afghanistan are coming home tomorrow. Members of the Sioux Falls-based 196th Maneuver Enhancement Brigade are to arrive at Fort McCoy in Wisconsin about 2:45 p.m. Thursday. They'll spend several days going through the demobilization process before returning to South Dakota. A homecoming is being planned at Augustana College campus next week.
Unused prescriptions can be dropped of Saturday
If you have unused prescription drugs, you have the chance to drop those off Saturday and be part of the National Prescription Drug Take-Back Day. The Drug Enforcement Agency's website lists several sites where you can take unused, unwanted and expired medications, and it's free and anonymous. The collection site for the area is the Sioux Falls Police Department Lobby on West 4th Street. It's Saturday from 10 to 2.
Man Convicted of Sex Crimes Gets 75 years
42-year-old Taras Michels of North Sioux City will serve 75 years after being convicted of two sex crime charges. The South Dakota man admitted to hundreds of offenses has been sentenced to serve 36 years in prison on two sex crime charges before being eligible for parole. Union County State's Attorney Jerry Miller wanted Life plus 15 years.

Quasquicentennial Farm Event
Farm families who have endured 100 or 125 years of life on the farm or ranch have the opportunity to be recognized during the South Dakota State Fair on Thursday, Sept 1.

Grand Falls Opening Delayed
The Grand Falls Casino Resort's pushed back its' grand opening to June 9. KDLT reports the resort was supposed to open Memorial Day Weekend, but officials say extremely wet site conditions have moved the project back two weeks. A Resort spokesperson says over 2,600 people attended the casino's recent job fairs.

Firefighters are making pancakes this weekend
Governor Daugaard will be in Brandon this weekend for the 45th Annual Loyalty Day Parade Sunday afternoon. It will be a weekend of festivities, with the Brandon Fire Department dance this Saturday night, and the Splitrock Fire Department pancake breakfast Sunday morning from 8am to 1pm. The pancake breakfast will be at the Splitrock Fire Department…a good spot to hit before the parade.

Blue Diamond Casino Robbed
The Blue Diamond Casino in Sioux Falls was robbed at gunpoint early Monday making it the third robbery in three years. The robber walked into the casino just before 1:30 in the morning and demanded the cash according to Sam Clemens, spokesman for the Sioux Falls Police Department. The suspect was described as 5 feet 10 inches to 6 feet tall with a medium build. He was wearing a dark hooded jacket, light-colored pants with light-colored shoes and a dark facemask.
Escapee Sought
Inmate Kent Davidson walked away from Unit C, the minimum security facility on the grounds of the South Dakota State Penitentiary in Sioux Falls, early Monday afternoon. Police are now searching for him. Davidson is a white male, 5-feet-10 inches tall and weighs approximately 160 pounds. He has blonde hair and blue eyes. If you see him, call police.

The Hy-Vee store at 26th Street and Sycamore Avenue in Sioux Falls was evacuated as a precaution after a fire yesterday morning. The fire broke out just after 9 o’clock. An electricle problem on a loading dock was the blame. The fire was estinguished before fire crews arrived.

A body found on the Nebraska side of the Missouri River on Sunday is that of Kyle Bender.

Trooper Assault Trial
A Sept. 7 trial date's been set for an Onida man accused of assaulting a South Dakota Highway Patrol trooper. KDLT reports 76-year old Chester Strickland's pleaded not guilty to assaulting and obstructing a law officer as well as possessing a concealed weapon without a permit. Strickland's accused of punching a female trooper in the face during a traffic stop last August.
Car Vandalism
Sioux Falls Police are investigating at least 30 car vandalisms that happened early Sunday morning. Police say windows on the cars were broken out by a some sort of long pole-like object. Sioux Falls School Calendar
Changes to the Sioux Falls public school calendar will give students an extra week of summer this year, and a proposal for 2012-13 aims to keep it that way. The school board tonight will hear a committee's recommendation for the 2012-13 calendar. The Argus Leader reports the plan would start school Aug. 20, 2012, and end May 15, 2013. The 2011-12 calendar, decided one year ago, will run Aug. 22 to May 15.
Body could be that of Yankton man
A body found in the Missouri River over the weekend has been sent to Sioux Falls for an autopsy. Authorities think the body could be that of 26-year old Kyle Bender who was last seen December 11, and they expect tattoos to help them make a positive ID. The body was discovered by a Yankton fisherman over the weekend. Clothes and a cell phone belonging to Bender were found near a boat ramp in Yankton in mid-February, but searches after that came up empty.
Komen Foundation opens local office
Susan G Komen for the Cure has opened an office in Sioux Falls. A ribbon cutting was just held, and the office will be staffed with a full-time state director. The goal is to open a second office in Rapid City staffed part-time. The Komen foundation fights breast cancer around the world.
Flasher Arrested
A Sioux Falls man accused of dropping his pants in front of shoppers at The Empire Mall was being held Friday in the Minnehaha County Jail on charges of indecent exposure. 24 year old Naite Kolula is the accused in the indecent incident. Several witnesses told police that Kolula had flashed them on his way out of the mall just prior to being arrested.
School Buses Alter Routes
West Central School District will run buses only on paved roads beginning next week to reduce wear on gravel township roads feeling the effects of a hard winter and wet spring.
Notice of the busing change has been sent to parents of West Central students, and the district's business manager, Susan Kurtz, confirmed the move. Other Minnehaha County school districts have had to adjust busing operations to avoid township roads.

The Magnolia Steakhouse Closes Unexpectedly
The Magnolia Steakhouse in Luverne(Luh Vern), Minnesota has closed its doors. The restaurant has been a southwest Minnesota mainstay since 1938. There's no word on why it's closing, leaving customers and employees scratching their heads. A business next to the restaurant says business at the place has been good recently.

DUI Sends Man Back to Prison
The Sioux Falls man who killed an Iowan in a drunk boating accident in 2005 is going back to an Iowa prison for a Minnehaha County DUI. 35-year old Justin Nearman was sentenced to 52-years in prison and 5 years probation for the 2005 incident. In November, a year and a half out of prison, The Argus Leader reports Nearman was busted for DUI in a Sioux Falls traffic stop. He plead guilty last month, and his probation was revoked this week.
Noem No More Debt
Republican Congresswoman Kristi Noem says she won't vote to raise the debt ceiling unless it is attached to spending caps or a balanced budget amendment. The Argus Leader reports Congress will decide in the next month whether to borrow more money or risk default, something many economists say could wreak havoc on the U.S. economy.

Cabins Damaged on Poinsett
Strong Winds did some damage in Poinsett (Pon Set) as some cabins were destroyed. The water at Lake Poinsett was already at record levels, but thestrong winds dashed people's hopes of living here anytime soon. The winds were gusting around 25 mph.

Cuts announced
The University of South Dakota says it will cut a dozen positions and eliminate a nursing program at Watertown to cut the budget. The six South Dakota universities need to find almost 5 million dollars in reductions. USD President James Abbott says he’s acting based on recommendations from the university system’s budget committee.

Troops about to head home
A South Dakota National Guard unit is headed home. The 196th Maneuver Enhancement Brigade from Sioux Falls has been overseeing about a dozen bases in Afghanistan for about a year, and has turned that over to a Massachussetts unit. The Sioux Falls unit will be home next month.
Blunt Force Trauma Reason For Death Of Gaurd
A coroner has determined that the correctional officer killed at the State Penitentiary in Sioux Falls died from blunt force injury. Ronald E. Johnson was killed April 12 when two inmates attacked him during an escape attempt. Rodney Berget and Eric Robert, are charged with murder.
Traffic Light Wait Times Could Be Reduced
Your commute through SF may get a little quicker this morning. Traffic lights were adfjusted at 9 last night to dected cars approaching instead of running on a timed schedule. Officials say this could cut wait times at lights from 90 to 30 seconds.

First National Names Resolved
First National Bank South Dakota will close its downtown Sioux Falls branch to comply with the most recent ruling in a legal battle over a bank name that’s lasted nearly two decades. First National Bank in Sioux Falls and First National Bank South Dakota have been in federal court off and on since 1994. First National Bank South Dakot's been ordered to rename its' branch at 100 S. Dakota Ave. Instead, they'll close that branch July 8th.
Pipeline Eminent Domain Suits
The number of eminent domain lawsuits TransCanada's filed against South Dakota landowners along the route of its proposed Keystone XL oil pipeline is up to 21 from 13 in January. Many South Dakota landowners have granted easements for the 1900-mile long pipeline that's expected to move oil from Canada to Texas. But many have concerns about such things as liability issues and potential groundwater contamination. TransCanada says it sues to condemn land only as a last resort, after easement negotiations fail.
Emergency contact card developed for non-English speaking
The Sioux Falls Police Department and Multi-Cultural Center have developed an emergency contact card for non-English speaking people. The card lists a person's name, primary language, and emergency contact person. Individuals can get the free card from the Multi-Cultural Center.
Lions fundraiser draws thousands
The Sioux Falls Convention Center is open until 8 tonight for pancakes. It's the Lions Club's annual fundraiser, with 13,000 people expected to go through the doors. Two hundred volunteers are dishing out close to 60,000 pancakes and 38,000 sausages over the two day event. It's $6 at the door, and proceeds go to several local charities. The Lions are also collecting hearing aids, glasses, and batteries at the door.
Sentence Of Brandon Quincy Thompson Goes Beyond Life
It's Life plus 10 years for a Tea man who pled guilty to sex trafficking of a child by force and solicitation to murder a federal witness. Brandon Quincy Thompson appeared before Chief U.S. District Judge Karen E. Schreier and was sentenced to life imprisonment for the sex charge and 10 years for the solicitation of murder charge.
Packed Boat Ordinance hearing
It was a packed house at the boat ordinance hearing last night. Despite some arguments that it would keep visitors away, the Lyon County Board voted in favor of an ordinance that would prohibit the use of gasoline powered motors on on West Twin Lake. East and West Twin Lake, located in Shelburne Township south of Florence, are the site of planned development for a county park and campground.

No Cuts at Dakota State
A loss of some state funding won't mean layoffs or program cuts at Dakota State University. Dakota State President Doug Knowlton says the Madison school will hold positions open or not expand them to counter a loss of $300,000 in state money. Knowlton tells KDLT a bigger funding cut might have led to cuts, but the school recently raised tuition and fees.
Big Sioux Rising
The Big Sioux River is already above flood stage just north of Sioux Falls where it comes into the city, and recent rainfall's expected to push the river up another foot before it crests in the next few days. KELO reports city engineers say everything should be ok, because the crest will probably be about 3 feet lower than where it peaked last month.
SF Sewer Rates Going Up
The Sioux Falls City Council approved hiking sewer rates, but they're not happy about it. The rates rise 5% in July and 8% next January. One councilor says it stinks...pun intended. There've been 5 previous rate hikes since 2007. KSFY reports a sewer line ruptured last summer, forcing the city to dump raw sewage into the Big Sioux. The city will be spending millions on upgrades.
Fire Chief to retire
Sioux Falls fire chief Donn Hill announced yesterday he'll retire on June 3rd. Hill started his long career with Sioux Falls Fire Rescue in 1982 and was named chief in 1997. He resigned the position in 2006 and was reappointed in 2007. A search committe is being assembled now to recommend top candidates to replace Hill.
Casino job fairs drawing crowds
Job fairs are going on this week for the Grand Falls Casino that will open in Larchwood, Iowa later this spring. The $120 million resort will employ more than 700 people and includes a casino, events center, and 100-room hotel. The line was so long at a job fair Sunday in Sioux Falls, they opened the doors twenty minutes early. There's another job fair Friday in Brandon before wrapping up Saturday in Sioux Falls.
Minnesota Avenue reopened
It was closed early this morning, but fire officials say Minnesota Avenue in downtown Sioux Falls is open again. A car inside Graham Tire caught on fire, causing smoke damage to the building. Minnesota Avenue was blocked for about an hour – until 5 a.m.
Naming Rights Decision Delayed
Naming rights will be delayed. At it's meeting last night, the SF city council decided to delay the decision to grant naming rights after hearing form an industry expert on the matter. The city did decide to spend $65,000 on a consultant who will calculate the amount of money businesses will pay. The Superlative Group from Cleveland, Ohio proposes to not only look at naming rights for the events center but also the Sioux Falls Convention Center, Washington Pavilion and the Zoo.
Natural Causes Ruled In Death
The man found in SF Friday died from heart failure. That's the results from an autopsy performed on the man who was found in an industrial area on the north part of the city. No foul play is suspected.
Flooding Persists
High waters are a continuing problem for some lakes in the northeast part of the state. Sen. John Thune got a first-hand look at the damage yesterday. Since Friday morning, water at Lake Thompson has come up about an inch and covers part of the road on the north side of the lake, and both park officials and property owners worry that hte wind will make it worse. Some residents are calling it the worst they've ever seen.

Man who fakes death gets prison time
46-year old Vij Misir is accused of faking his own death so his wife could collect insurance money. He was sentenced to 36 months in prison today for conspiracy to commit mail fraud. The insurance policy was drawn on Sioux Falls-based Midland National Life.
SD tribes get grant money
Two Indian tribes in South Dakota will be part of a federal program to improve eating habits through nutrition education programs. The Rosebud Sioux Tribe will receive $94,000 and the Oglala Sioux Tribe $75,366. The program from the U.S. Agriculture Department provides $1 million to 15 applicants in 10 states.

NorthWestern Energy Scam
NorthWestern Energy is warning its customers and others of a check-cashing scam using the company's name. People in other states are reportedly getting a check for 2650 from NorthWestern Energy with a letter stating the recipiuent was chosen for a survey. The letter says to deposit the funds and immdsiately send a wire transfer to a pre-determined "relative."

Teen Deaths Appear to be Suicide
The Lyon County Sheriff's Office in Marshall, MN is investigating the death of two 14-year-old girls. The identity of the girls have just been released. Haylee Fentress and Paige Moravetzfrom Lynd, MN were the girls found dead early Saturday morning in Island Lake Township. No foul play is suspected as it appears to be a case of teen suicide deaths.
Facility members and staff from the Marshall School District, where the girls attended school, are trying to reach out to as many students as they can in this difficult time. The superintendent says they will be offering grief services in the days ahead.

Police are looking for two who robbed a SF bar. two men with bandanas covering their faces entered the Silver Moon shortly after 11 p.m. Saturday, hitting a person on the head, firing one shot in the air demanding cash from patrons. The pair raided the cash drawer then left. The man who was hit with the handgun was treated at a local hospital and released. If you have information, call police.

Man Gets Life for Prostitution Ring
The man accused of running a Tea based sex ring's gotten life in prison. Kelo reports a federal judge sentenced Brandon Thompson for running an online prostitution ring with at least 10 underage girls dating back to 2009.

Body found, no foul play suspected
A body was found Friday morning in northeast Sioux Falls, on a tree farm run by Family Tree Company. Police Spokesman Sam Clemens says there doesn't appear to be any foul play, but they're treating it as they would any death investigation. The body was a middle-aged white male with jeans shorts and a shoe just on his left foot. He was lying near a truck used to haul trees. Police are releasing more details as they have them.

South Dakota's second annual Governor's Ag Development Summit is set for June 29 at the Sioux Falls Convention Center. It will encourage the use of innovation and technology to boost the state's agricultural economy. Gov. Dennis Daugaard says economic development is one of his top priorities, and agriculture generates thousands of jobs in rural communities across the state.

Fake Drivers Licenses
1,700 high quality, but fake driver's licenses have come to the U.S. from China through Chicago's O'Hare Airport since the beginning of the year. Most of them were addressed to college students in 7 states, including South Dakota. KELO reports federal officials say they're investigating some of those recipients. AMong the other states on the list: Illinois, Ohio, Wisconsin, Florida, Georgia and Pennsylvania.
More Using Aberdeen Airport
More people are using the Aberdeen airport this year. Manager Mike Wilson tells KELO boardings for the first three months of the year were up about 1,100, or 27% over the same period last year. The increase might be the result of larger jets serving Aberdeen and economic growth.
How Inmates KIlled Guard in Escape Try
Investigators say the two South Dakota inmates who tried to escape the Penitentiary earlier this week, attacked a 63-year-old prison guard, wrapped his head in plastic shrink wrap and left him to die before using his uniform to sneak past security. Eric Robert and Rodney Berget, both 48, are charged with first-degree and felony murder.
Brandon Counterfeit Cash
Counterfeit money was found in Brandon again this week. The Argus Leader reports the chamber of commerce sent a mass email alert to its members early yesterday that a phone $20 was in the bank deposit of a member business. There a another phony money incident back in February, in which someone passed a counterfeit $5 bill.
SDSU continues cutbacks
South Dakota State University is going to eliminate two of eight agricultural experiment stations - one in Highmore and one in Miller. That will involve a loss of jobs. The school faces a $4.9 million loss of state funds. They've also eliminated the program that trains park managers and rangers, and restructured the Cooperative Extension service, resulting in 17 lost jobs.

The Brandon Valley Area Chamber of Commerce is bringing U.S. Representative Kristi Noem to Brandon next week for a Town Hall Meeting. It will be Thursday, April 21st at 6:30 pm in the Brandon Performing Arts Center. The public is encouraged to attend. She will be taking questions from the audience.

Officials in South Dakota will wait for a resolution to Cody Larson's most recent legal troubles before deciding if they violate condition of a case the freshman forward settled there last year. Larson was charged with third-degree burglary, a felony, in St. Augustine early Sunday after witnesses told police he and teammate Erik Murphy broke into a car. His most recent legal issues raised questions of how they would impact terms set by a judge in Minnehaha County last year.
Signal Work Nearly Complete
The state Department of Transportation is working on traffic signals at Powder House Road and Arrowhead Parkway in Sioux Falls. The signals will be shut off while a signal pole in the northeast quadrant is relocated. Work should be complete and signals back in operation sometime today.

Jobs Data
The U.S. Bureau of Labor Statistics says South Dakota's preliminary unemployment rate for March was 4.9 percent, up slightly from February's but down from 5.1 percent in March 2010. KELO reports although the jobless rate hasn't changed much in the past few months, the state says the economy's picking up steam, with 2900 workers added this year, compared to a loss of 5200 the same time a year ago.

The 2 State Penitentiary inmates who tried to break out yesterday are not each charged with 1st degree murder and felony murder kidnapping in the death of Senior Correctional Officer Ronald Johnson. KDLT reports both charges are class A felonies and have a mandatory penalty of death or life in prison.

Seventeen Cooperative Extension educators are being let go under a restructuring plan that is requiring all educators to resign and apply for new positions.

Brandon business discovers counterfeit bill
The Brandon Valley Area Chamber of Commerce is warning there may be counterfeit bills circulating. A Brandon business tried to deposit a $20 bill in the bank and discovered it was a fake. This is the second counterfeit $20 discovered, and there has also been a fake $5. The FBI is involved in the investigation.

The 50th annual State Finals of the 2011 Resource Conservation Speech Contest were held recently in Pierre with 11 contestants. Receiving third place and a $450 scholarship was Grace Chang, sponsored by the Minnehaha Conservation District. She is a senior at Lincoln High School and is the daughter of KC and Irene Chang of Sioux Falls.

A South Dakota State Penitentiary correctional officer is dead after an escape attempt yesterday morning.
Inmates Rodney Berget and Eric Robert were caught trying on prison grounds during an escape attempt just before 11 a.m. An officer was assaulted during their escape attempt and was taken to a Sioux Falls hospital by ambulance. The officer was pronounced dead shortly before noon.

With less than a 13 percent turnout, Brandon Mayor Larry Beesley gewts another 4 years in office. The incumbent was challenged by Alderman Dan Mostek. Beesley came away with 399 votes, to Mostek's 306.

Little Robber Dam Problems
An earthen dam in south-central Wyoming's in danger of failing and possibly washing out highway 789 in Carbon County, but officials have downgraded the failure risk from eminent to possible. The Billings Gazette reports the problem's an outlet pipe halfway down the 55-foot high Little Robber Dam. The roads about a mile downstream. The dam holds 200-million gallons of water. Yankton Schools Cuts and Opt Out
The Yankton School District is laying off 22 teachers to save money. School board president Mike Stevens tell KELO while they don't expect to make any more personnel cuts, more spending cuts are possible. The boards scheduled a May 24th public vote on a $4.1 million opt out to the property tax limit. Stevens says that's the minimum the district needs.

School officials won’t confirm, but a senior chemist at the Olson Agricultural Analytical Service Lab says staff members have been told it’s being closed next October. Budget cuts at SDSU are being blamed. The University will discuss how it’s dealing with a nearly 5 million dollar reduction in state funding next year.
Teller pleads not guilty to bank fraud
One of two tellers accused of stealing from a Sioux Falls bank has pleaded not guilty. Vivian Mason pleaded not guilty to bank fraud in the theft of $92,000 from Wells Fargo. The second suspect, Michael Edwin Smith, hasn't entered a plea yet to charges of bank fraud and making false bank entries. Authorities allege the two took money from teller drawers and falsely recorded that it had been transferred to an ATM.

Police in Iowa arrested a Sioux Falls man after a high speed chase. 48-year old Eric Hopewell now faces several charges including eluding. Deputies say he took off after a routine stop , topping out over 100 miles an hour. Hopewell and the deputy crashed into a ditch and

Wind takes Down Barn
Strong winds took down a barn in the Hartford area around 9 o'clock Saturday night. Winds in excess of 60 miles per hour are to blame for the leveling of the 100 year old structure. The National Weather Service says a gust front from a dying storm ripped through the area.
Lake Traverse Overflow
An overflowing Lake Traverse on the Minnesota and South Dakota border is surrounding some cabins and closing in on homes in Roberts County. Authotrities say the water should be receding at this point. The U.S. Army Corps of Engineers controls the flow of water from a dam on the lake's north side. The Corps closed the dam’s gates because a river Lake Traverse flows into was and is still too high downstream.

South Dakota Department of Transportation will be working on the traffic signals at the intersection of Powder House Road and Arrowhead Parkway in Sioux Falls today. Drivers should expect delays and be prepared to stop for work crews. Traffic control through the intersection and work zone area will be maintained with 4-way stop signs and flaggers. The shoulder in work areas will be closed, however, through traffic will be maintained.

I-29 Construction
Construction starts this week on crews this week replacing a section of northbound I-29 at the 26th Street interchange. The work's expected to take 3 weeks. The Argus Leader reports traffic will be shifted to the outside lane and shoulder. The speed limit will be dropped from 65 mph to 55 mph at all times and down to 45 mph through the work zone while crews are there.
Judiciary Women
State Supreme Court Justice Judith Meierhenry's retirement announcement has got people talking about women in the judiciary. The Argus Leader reports that despite several decades of near gender equity in enrollment at the USD School of Law, there are few women on the bench. If Gov. Daugaard replaces Meierhenry with a man, the high court again will be an all-male group. The governor says gender isn't a "primary criteria" in determining who will get any judgeship - circuit or otherwise.
Hearing coming up
A hearing is scheduled a week from tomorrow for 28 year old Jerrin Stulken. He faces alternate counts of murder and manslaughter in connection with a deadly parking lot fight last month in Watertown. The fight was March 13 and 26 year old Justin Jaton died of his injuries 18 days later.
Brandon parents favor all-day kindergarten
The Brandon Valley Board of Education heard from parents last week who favored all day kindergarten. The testimonies will help board members decide how much all-day kindergarten to offer in the 2011-12 school year, if any.

The South Dakota Board of Regents publishes a report each year that ranks the state's high schools according to their graduates' freshman year college grade-point average. The Argus Leader reports graduates of smaller schools in South Dakota have been outperforming students from bigger schools at state-run universities. Those who left the state to attend college aren't included in the report.
Former Roosevelt star arrested
Former Roosevelt High School standout Cody Larson has been arrested in Florida. Larson and another basketball teammate were arrested early Sunday morning in St. Augustine on a felony count of burglary after attempting to break into a car. Larson was suspended from Roosevelt’s basketball team during the 2010 season after he shared prescription pain killers with a teammate. He received a 120-day suspended jail sentence and two years probation in May.
Gas Certificates From Local Church On Good Friday
New Life Church members will be handing out certificates for free gasoline from 4 to 6 p.m. April 22 at the Get N Go at 14th Street and Minnesota Avenue. It's an effort to by the SF church to do something for God's people according to minister LaVar McBeth. The giveaway will run for two hours or until funds run out, McBeth said.

South Dakota's smaller public high schools have been generating higher grades by graduates at colleges and universities. The South Dakota Board of Regents publishes a report each year that ranks the state's high schools according to their graduates' freshman year college grade-point average. An Argus Leader analysis of the 2005-09 data suggests that a high school's size and type make a difference in college readiness.

SD in Running for New Plant
South Dakota's in the running for a new meatpacking plant. Texas-based First American Farms, is looking at several possible locations for a new plant to make kosher and halal beef. One of the sites being considered is along Interstate 29 south of Beresford, in Union County. The county also is the potential site of an oil refinery. A company spokesperson tells KDLT the plant would process meat that meets Jewish and Muslim dietary rules.
Daugaard Fills Judicial Vacancy
Gov. Daugaard's named Cheryle Gering of Freeman as a circuit judge in southeastern South Dakota. KELO reports Gering will fills a vacancy created by the June retirement of 1st Judicial Circuit Judge Arthur Rusch. Daugaard cites Gering's legal experience and also her "diligence, common sense and even temperament" as reasons for his decision. The 1st Judicial Circuit includes Aurora, Buffalo, Clay, Davison, Douglas, McCook, Turner, Union and Yankton counties.
Loan Scam Guilty Pleas
Two of the prime players in a multimillion dollar loan scam that defrauded investors out of millions, entered guilty pleas today in federal court. The Argus Leader reports 74-year old Ken Cahill of Liberty Iowa, and 65-year old Tom Pokela of Sioux Falls, made deals for conspiracy to commit wire fraud, and will serve a maximum 5 years in prison. A third co-conspirator, Wes Austin, also took a plea capping his prison time at 11 years.
South Dakota becoming less peaceful, report says
If you think South Dakota is a pretty peaceful state, well it has gotten less so in recent years. The most peaceful state in terms of the lack of violent crime and the low jail populations, is Maine. Louisiana is the least peaceful. South Dakota saw the largest decline due to a steady rise in incarcerations and the number of police without a fall in the homicide and violent crime rates. The state now ranks 14th. The general conclusion of the study seems to be the southern states are the least peaceful, and the Midwest generally fares much better. The Northeast wins overall.

A facebook movement continues to gain momentum. The Project Help your Neighbor page was created after Gary and Darlene Nipp of Sioux Falls lost their home to a fire more than a year ago. The Nipps' neighbor, Clint Siemonsma, is bringing businesses together to help rebuild the home free of charge. All the labor will be donated, and they need donations for the materials.

Arson At Home, No Injuries
A SF Family says they're lucky to be alive, but the fact that arson was the cause of the blaze that put them in jepordy is alarming. Early Thursday morning someone set fire to this Summit Avenue home as well as the truck in the driveway. Using the garden hose and buckets, neighbors were able to douse the flames before firefighter arrived. A few weeks ago the same family's van burned down. No suspects or motives have been mentioned.
Rollover Crash injuries Driver
Sioux Falls Police, Fire Rescue and Rural Metro Ambulance were called to the scene of a rollover crash last night. It happened at 12th Street and Kiwanis Avenue. One person was trapped inside the vehicle. The crash happened after the driver drifted into the right lane hitting the curb. The driver sustained non-life threatening injuries and was transported to Sanford for evaluation. He was also arrested for DWI and other traffic related offenses.
Controlled Burns Need to be Monitored
At least two grass fires were reported Tuesday in rural Minnehaha County north of Sioux Falls and fire officials warn that the fires need to be watched until completely out if residents are doing controlled burns. On Wednesday, Sioux Falls Fire Rescue was called to a grass fire near 41st Street and Cliff Avenue. Several area fire departments also responded on Wednesday to a fire near 484th Avenue, where the railroad crosses it near Garretson.

Man Killed by Pennington Deputy was Arrmed
South Dakota's Attorney General says the man killed by a Pennington County Deputy last night was armed. Deputy Ed Johnson was sent to 6248 Blake Road for a traffic complaint just before 7:00 p.m. KELO says when he got there he tried to contact the owner of the vehicle, when he heard a gunshot from a garage on the property. He found a 43-year-old man carrying a scoped rifle and handgun. The attorney general says it ended with Johnson firing his duty weapon, killing the suspect, who's name hasn't been released.

Lake Kampeska's still rising. KELO reports it's now expected to crest at some point over the weekend. But, until then homeowners along the lake will be a little nervous about the ice that still hasn't melted.

Sioux Falls police are investigating what appears to be arson, after a fire overnight. Crews were called to 820 North Summit Avenue around 1:20 this morning after a truck and a door to a home were set on fire. Police are still looking for a suspect. There were no injuries.
100-year sentence overturned
The Associated Press reports the South Dakota Supreme Court has overturned the 100-year prison sentence given to a Pierre man convicted of possessing child pornography. Troy Bruce’s conviction on 55 counts of possessing child pornography for videos found on a DVD was upheld. But the justices say his sentence violates the constitutional ban on cruel and unusual punishment because it’s disproportionate to the crime. The ruling sends the case back to a circuit judge, who will sentence Bruce after comparing his case to sentences imposed in similar cases.
Kvasnicka Convicted
Tammy Jean Kvasnicka has been convicted of first-degree manslaughter for her role in a July 2010 accident that killed 27-year-old Michael Xayavong and severely injured 25-year-old Tony Chounramany. She was driving the wrong way on Interstate 229 in Sioux Falls and struck the car in which Xayavong and Chounramany were riding. Manslaughter carries a sentence of up to life in prison.
Road Clooapse
A road collapse in Minniehaha county has a mile stretch of County Highway 104 shut down. While the road is not covered with water, the Big Sioux River is still on the rise in the area toward a second crest. The water has also gone up considerably at Trent, but the roads there are still passable.

Minnehaha Charging More to House Inmates
Counties that rely on the Minnehaha County Jail to house their inmates will be paying $3/day more for their room and board. The County Commission's voted to raise the rate from $74.35 to $77.26/day. The Argus Leader reports the county also raised the rate for work-release inmates, from $32 to $35 a day. 15-counties currently contract with Minnehaha County for housing inmates.
Bridgewater Man Gets 10-years for Kiddie Porn
A Bridgewater man who plead guilty to possessing child porn's been sentenced to 10 years in federal prison. 45-year old Kevin Houston entered the guilty plea last November. KELO reports investigators found the child porn in his Bridgewater home in August 2009, after Houston became the target of a sexual assault on a minor in August of 2009. He's plead guilty to the Wisconsin charge and will be sentenced there April 25th.
Residents okay after house fire
A house fire west of Sioux Falls today resulted in no injuries, but the house sustained heavy damage and 7 of 10 family cats died. The blaze happend just east of Highway 17 and off of 268th street in Sioux Falls. The residents were home at the time and were able to make it out okay.
Woman arrested for pulling knife on boyfriend
51-year old Diane Buckman of Sioux Falls has been arrested on assault charges after pulling a steak knife on her boyfriend Tuesday. Police say once Buckman grabbed the knife the two began to wrestle and the knife broke. Buckman was arrested at the scene, on South Baha Avenue.
Gourmet Guys set for May 1
The 10th Annual Gourmet Guys: Great Food for a Great Cause is coming up May 1 at Active Generations. Forty prominent men will be dishing up their culinary creations, raising money to support activities and programs for older adults who need help and for those who strive to stay healthy and active. Sunny Radio's John Small will be whipping up his best dish. Taylor Landenburger from the Sioux Falls Snowfox Swim Team will be featured as the Youth Gourmet Guy.
Coust to House Inmates Increased
County Jail inmates will cost more to be housed and fed. Minnehaha County Jail will pay almost $3 per day more each for their room and board after the Minnehaha County Commission voted to increase the rate. On Tuesday, the commission approved the increase from $74.35 to $77.26 per day. The rate for work-release inmates also went up, from $32 to $35 a day according to the Argus Leader.
Woman Says She Can't Remeber Crash
The woman accused of killing a Sioux Falls man in a drunken driving accident last summer says she couldn't remember the crash. Tammy Kvasnicka is on trial for manslaughter, vehicular homicide, vehicular battery and DUI this week in Minnehaha County for the crash, which killed 27-year-old Michael Xayavong and severely injured 25-year-old Tony Chounramany on July 10.
Brandon mayor Race
Brandon city voters head to the polls April 12th to decide who gets the nod for Mayor. The two squared off at a public forum hosted by the Brandon Valley Area Chamber of Commerce, the Brandon Valley Challenger and Sunny Radio. Incumbent mayor Larry Beesley is being challenged by Ward 2 Alderman Dan Mostek. Beesley has two terms as mayor under his belt. Mostek has represented Ward 2 for 12 years.
Senior Center Expansion
A senior center in Brandon is seeing growth. Bethany Meadows will begin a major expansion, adding a nursing home to its campus and making way for the addition of assisted living apartments in Sioux Falls. Dennis Sever, Bethany Lutheran Home administrator says the two part project will allow the company to offer a wider range of services in Sioux Falls and Brandon.

SF Mayor Wants More Incentives to Attract Business
Sioux Falls Mayor Mike Heuther says his office is looking at what incentives can be offered to bring business to the city. Heuther tells KELO the city isn't offering enough incentives, and he's looking at duplicating some of the things already in place at the state level.
Floodwater Rising
Floodwaters continue to rise in parts of eastern South Dakota. KSFY reports communities along the Big Sioux River from Watertown south face a week of cresting. Between Watertown and Brookings, officials are watching lakes Kampeska and Poinsett, where rising water's threatening homes and other property. Hamlin County Emergency Manager Dave Schaefer says 50 prison inmates and staff are filling sandbags at a resort on Lake Poinsett.
Woman claims $5000 prize
South Dakota has been lucky lately when it comes to winning Wild Card 2 lottery tickets. Beverly Javers of Lennox just claimed a $5000 prize yesterday at the Sioux Falls Lottery office for a win Saturday night. It's the game's second prize and the odds of winning are about 1 in 90,000.
Pet clinic expands in Brandon
If you're wondering why a 22-year old day care building was torn down last week in Brandon, it's to make room for a new facility for animals. Horizon Pet Care is expanding to a new 60x80 foot structure at 11 East Holly Blvd. You'll see construction this summer, and they hope to open by Labor Day.
Karsky Gets Seat Lost to Litz
Minnehaha County Auditor Bob Litz's previous seat has gone to Dean Karsky. The Seven council members announced their choice one by one, and in a final vote of 6 to 1, Karsky was declared the new member.Karsky ran for this same seat back in 2006.

DUI Trial
Tammy Jean Kvasnicka is on trial this week in the death of 27-year-old Michael Xayavong. Kvasnicka is accused of driving the wrong way on Interstate 229 and crashing into a vehicle Xayavong was riding in. Jurors will be asked to decide how severely Kvasnicka ought to be punished.

DART Wants to Hear from You
Des Moines Area Regional Transit Authority is inviting the public to comment on how DART should develop during the next 25 years. The Des Moines Register reports you can take an on line survey,at www.surveymonkey.com/s/DARTforward or attend one of four public meetings..there's on tomorrow at the Des Moines Central Library, 1000 Grand Avenue, at 11:30 a.m. or 5:30 p.m. Wednesday.
Rapid City Aiport
Rapid City Regional Airport wants nearby city and county governments to strengthen zoning restrictions to prevent future development that could pose hazards to airport operations. KELO reports among the items the airport wants limited including building heights, wind farms, and landfills or sewage lagoons that could attractb birds.
New Secreteary of Prisons
Denny Kaemingk of Mitchell, chairman of the Board of Pardons and Paroles, has a new job. He's been picked by Gov. Daugaard as the new Secretary of the Department of Corrections. The Argus Leader reports Kaemingk will start managing the state's prison system on May 9.
TCF Suit In Federal Court
The national debate about debit card swipe fees touched down at the Sioux Falls Federal Courthouse today. TFC Bank's brought a civil suit against Fed Chairman Ben Bernanke and the agency's board of governors over the constitutionality of an amendment to last year's banking reform law that caps the fee banks can charge retailers for debit card transactions.
Anti-bullying seminar April 28
Communities are coming together to prevent bullying. There's an evening coming up at Our Savior's Lutheran church where Dr. Carl Pickhardt and Shane Windmeyer will discuss bullying in schools, gay and lesbian issues, and promoting environments of respect and safety. It'll be April 28 from 7 to 9pm. Parents, educators, and anyone in the community is welcome.
Johnson sponsors legislation to help rural schools
U.S. Senator Tim Johnson of South Dakota has co-sponsored legislation that would level the playing field when it comes to funding for rural school districts in South Dakota and across the nation. The measure would target funding so rural schools aren't left behind by federal programs. The South Dakota Department of Education estimates this would mean an increase in funding and better access to grants for South Dakota schools.
Card Fees Being Fought
U.S. District Judge Lawrence L. Piersol in Sioux Falls will hear arguments today on coming Federal Reserve regulations to limit “swipe fees,” the money merchants must pass along to banks in exchange for being able to accept cards as payment. TCF National Bank, a Sioux Falls-based unit of TCF Financial Corp says the fees will cause them to lose serious amounts ofg money.
No Teen Drunk Driving Deaths
There were no teen drunken driving deaths in Minnehaha County last year, and there have been none in Lincoln County since 2006. Leaders of an awareness campaign on the dangers of teen drinking say their efforts are paying off. Darcy Jensen, program coordinator for the Department of Public Safety's "Parents Matter" campaign says the message is getting out..
Plumbing Leads to Pot Bust
The Pot lead to a pot bust...it's a bad pun we know, but it's true and happened last week after Two area men caught growing marijuana in the Harrisburg Industrial Park last year were busted an overflowing toilet brought unwanted attention to their operation. The landlord of their apartment noticed a plumbing problem and investigated. He fininshed fixing the toilet, that's when he found the pot. Each of the men face 5 years.

Citigroup
Citigroup's filed an application with the Office of the Comptroller of Currency to merge Citibank South Dakota N.A. with Citibank N.A. The company's also is moving Citibank N.A.'s main office to Sioux Falls from Las Vegas. According to the Argus Leader, the change isn't expected to affect company operations here, or the bank franchise tax paid to the state.
Habitat Sioux Falls
Habitat for Humanity of Greater Sioux Falls has gotten a $50,000 grant from the Sioux Falls Area Community Foundation to put toward a new neighborhood revitalization project this spring. The grant's funded with money from City Blossom, an annual spring fundraising event at the community foundation. The Argus Leader reports Habitat was one of 100 affiliates in the U.S. chosen for the program, which is a new undertaking for the group.
New Iowa Casino has a job hunt in South Dakota
Job hunters, this is for you. A $120 million casino being built in northwest Iowa, just over the South Dakota border, is filling hundreds of positions. The Grand Falls Casino Resort near Larchwood is expected to open in late May. Their first job fair is in Sioux Falls on April 17. They're planning to hire all the employees they need from these job fairs. The casino will include an events center and a 100-room hotel. An 18-hole golf course is scheduled to open in 2013.
Awards passed out at Brandon Chamber awards
The Brandon Edge was named the Chamber’s Business/Organization of the Year this week. The Edge has taken charge of Santa Stops, Hometown Days, the duck races and has also helped plan and execute the annual Loyalty Day Parade and celebration in cooperation with the local VFW. Midwest Railcar Repair CEO Greg Carmon was presented the Chamber Achievement award.
Animals Need Your Help
Hundreds of animals are still without a home at the Sioux Falls Humane Society. During a 4 day stretch in March, the shelter took in nearly 100 animals. Donations are greatly needed to help out with the care of God's creatures in the facility. People are also needed to adopt some of the furry lovables who deserve better than a cold cage.
